Terms of Service

These Terms of Service ("Terms") govern your access to and use of PulseWatch (the "Service"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Description of the Service
PulseWatch periodically checks HTTP endpoints you submit and displays check results — including uptime status, response times, and a 7-day history — through a web dashboard. The Service is provided "as is" (see Section 6) and should not be the sole determinant of your website's operational status.
2. Acceptable use
You agree to use the Service only for lawful purposes. Specifically, you must not:
- Monitor URLs that you do not own or have explicit permission to monitor.
- Use the Service to perform denial-of-service attacks, abuse the check infrastructure, or submit URLs intended to harm or overwhelm our servers.
- Attempt to access another user's account, data, or monitored URLs.
- Reverse-engineer, scrape, or repurpose the Service or its data for a competing service without our written permission.
- Submit URLs that point to illegal content, malware, or phishing sites.
3. Accounts
Registration. You sign in with your email address. You are responsible for the email address you use — if you lose access to it, you may not be able to sign back in.
Limits. The free tier allows monitoring of up to 5 URLs. Accounts found to be monitoring more than 5 URLs without a valid paid plan may have excess URLs removed or be subject to account suspension.
Termination. We may suspend or terminate your account at any time, without prior notice, if we determine that you have violated these Terms. You may stop using the Service at any time. To delete your account, contact us at the address below.
4. Data and privacy
Your use of the Service is subject to our Privacy Policy, which explains what data we collect, how it is stored, and your rights. By using the Service you consent to the data practices described in that policy.
5. Service availability and monitoring accuracy
PulseWatch checks URLs approximately every 15 minutes. Because checks originate from a single infrastructure provider, factors outside our control (network routing, DNS propagation, upstream provider issues) may affect results. The Service does not provide real-time monitoring and is not designed for critical incident response.
You acknowledge that:
- A check result indicating "up" does not guarantee your site is accessible from all locations or from any specific user's device.
- A check result indicating "down" may be a false positive caused by transient network conditions between our check infrastructure and your server.
- The Service should be used as one data point among several when making decisions about your site's health.
6. Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, RELIABILITY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.
7. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PULSEWATCH AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR DATA USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), OR OTHERWISE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE GREATER OF (i) $50 OR (ii) THE AMOUNT YOU HAVE PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.
8. Governing law
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in San Francisco County, California.
9. Changes to these Terms
We may modify these Terms at any time. If we make material changes, we will update the "Last updated" date and note the change on our website. Your continued use of the Service after a modification constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Service.
